1. Agreement to Terms

By downloading, installing, or using JotPop ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

The App is operated by JotPop LLC ("we," "us," or "our"). These Terms apply to all users of the App, including users of the AI sticker generation feature and the custom keyboard.

2. Description of Service

JotPop is a mobile application that allows users to:

• Generate custom sticker images from text prompts using artificial intelligence
• Save generated stickers to a personal gallery on their device
• Use a custom keyboard extension to insert saved stickers into other apps
• Copy and share generated stickers via standard mobile sharing features
• Subscribe to a paid plan, or purchase a one-time top-up, for additional generations
• Report a sticker for review if they believe it is inappropriate

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years old. If we learn that a user is under 18, we will terminate their access immediately.

4. User Content and Prompts

4.1 Your Responsibility

You are solely responsible for the text prompts you enter into the App. By submitting a prompt, you represent and warrant that:

• Your prompt does not request the generation of content that infringes any third party's copyright, trademark, or other intellectual property rights
• Your prompt does not request content depicting real, identifiable individuals without their consent
• Your prompt does not request explicit, adult, violent, hateful, or otherwise harmful content
• Your prompt does not request content depicting or referencing trademarked characters, logos, or brands (including but not limited to Disney, Marvel, Nintendo, and similar properties)

4.2 Prohibited Content

The following prompts are strictly prohibited:

• Prompts requesting sexually explicit or suggestive content
• Prompts requesting depictions of violence, gore, or self-harm
• Prompts requesting content that harasses, threatens, or demeans any individual or group
• Prompts requesting content that infringes on third-party intellectual property, including trademarked characters and celebrity likenesses
• Prompts requesting content that promotes illegal activity, including illegal drug use or drug paraphernalia
• Prompts requesting profane, vulgar, or crude language rendered as text within a sticker
• Prompts designed to circumvent our content filters

Violation of these prohibitions may result in immediate suspension or termination of your access to the App.

4.3 Content Moderation

We use a combination of automated keyword filtering and OpenAI's moderation service to screen prompts before generation. Prompts that appear related to self-harm are met with crisis-support information rather than a generated image. We reserve the right — but are not obligated — to review, remove, or refuse to generate any content at our discretion. Our automated filters are not perfect; if you encounter inappropriate generated content, you can report it directly in the App — see 4.3A.

4.3A Reporting Content

If you believe a sticker you generated is inappropriate, you can report it from the Gallery or immediately after generation. Reporting sends the sticker's prompt and image to us for review, along with the reason you select. We use these reports to evaluate and improve our safety filters.

4.4 No Copyright in AI-Generated Output

You acknowledge that AI-generated images may not be eligible for copyright protection under applicable law. We make no representations about the intellectual property status of generated stickers. You assume all risk associated with your use of generated content.

5. Intellectual Property

5.1 Our Property

The App, including its design, code, branding, and non-AI-generated content, is owned by JotPop LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App without our written consent.

5.2 Third-Party AI Services

The App uses OpenAI's image generation API to create stickers. Your use of AI generation features is also subject to OpenAI's usage policies (openai.com/policies). We are not responsible for limitations, errors, or policy changes imposed by OpenAI.

5.3 Feedback

Any feedback, suggestions, or ideas you provide about the App may be used by us freely and without compensation to you.

6. DMCA and Copyright

We respect intellectual property rights and expect users to do the same. We comply with the Digital Millennium Copyright Act (DMCA).

If you believe that content generated through our App infringes your copyright, please send a written notice to our designated DMCA agent at:

Your notice must include: (1) identification of the copyrighted work; (2) identification of the infringing material and where it appears; (3) your contact information; (4) a statement of good-faith belief that the use is not authorized; (5) a statement that the information in the notice is accurate; and (6) your physical or electronic signature.

We will respond to valid DMCA notices expeditiously.

7. Subscription and Payments

7.1 Free Tier

The App offers a limited number of free sticker generations for new users. Free tier limits are subject to change with notice.

7.2 Paid Plans

Additional generations are available through subscription plans or one-time purchase packages, processed through the Apple App Store or Google Play Store. All payments are subject to the applicable platform's terms and refund policies.

7.3 Watermarks

Some plans include a small JotPop watermark on generated stickers; others do not. The specific benefits of each plan, including watermark status, are described at the point of purchase and may change from time to time.

7.4 Pricing Changes

We reserve the right to change subscription pricing at any time. Price changes will be communicated with at least 30 days' notice before your next billing period.

7.5 Refunds

Refund requests are handled according to Apple App Store or Google Play Store policies. We do not process refunds directly.

7.6 Usage Limits and Top-Ups

Subscription plans include a monthly generation limit. Unused monthly generations do not roll over to the next period. One-time top-up purchases do not expire, but — unlike a subscription — are tied to the device on which they were purchased and cannot currently be transferred to a different device. We enforce generation limits server-side; attempting to circumvent these limits is a violation of these Terms.

7.7 Cancellation

You may cancel your subscription at any time. Because subscriptions are billed through the Apple App Store or Google Play Store, cancellation is handled by that platform, not by us directly:

• In the App: tap your sticker balance at the top of the Create screen, then select "Manage or cancel subscription" — this takes you directly to your subscription settings in the Google Play Store (Android) or App Store (iOS).
• Directly through the platform: on Android, open the Google Play Store, tap your profile icon, then Payments & subscriptions > Subscriptions, and select JotPop. On iOS, open Settings, tap your name, then Subscriptions, and select JotPop.

Canceling stops future renewals. As described in Section 7.5, you will keep your plan's benefits through the end of the period you have already paid for, and we do not issue partial refunds for time remaining in that period.

8. Privacy

Your use of the App is also governed by our Privacy Policy, incorporated here by reference. Please review it carefully before using the App.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: THE APP WILL BE UNINTERRUPTED OR ERROR-FREE; GENERATED STICKERS WILL MEET YOUR EXPECTATIONS; OR THE APP WILL BE AVAILABLE AT ANY PARTICULAR TIME.

AI-GENERATED CONTENT IS PRODUCED BY AN AUTOMATED SYSTEM. WE MAKE NO REPRESENTATIONS ABOUT THE ACCURACY, QUALITY, APPROPRIATENESS, OR UNIQUENESS OF ANY GENERATED IMAGE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOTPOP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless JotPop LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you generate, share, or use through the App.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately. Locally stored stickers on your device are not deleted by us upon termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict of law principles.

Any dispute arising from these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association, rather than in court, except that either party may seek injunctive relief in court for intellectual property violations.

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through an in-app notice. Continued use of the App after changes constitutes acceptance of the updated Terms.
